1. Acceptance
By creating an account or using the Smashd app or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.
3. Your Account
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at play@smashd.gg if you suspect unauthorised access.
One person may hold one account. Account sharing or selling is prohibited.
4. Acceptable Use
When using the Service, you agree not to:
- Submit false scores or manipulate match results.
- Collude with other players to gain SRP or rank unfairly (boosting).
- Use cheats, bots, scripts, or any unauthorised automation.
- Harass, abuse, or threaten other players.
- Post or transmit content that is hateful, discriminatory, or illegal.
- Attempt to reverse-engineer, decompile, or exploit the Service.
- Create multiple accounts to circumvent bans or restrictions.
- Manipulate the app, the store, or any payment mechanism to obtain a price, discount, or access you are not entitled to (price circumvention).
Violations may result in score rollbacks, account suspension, or permanent ban at our sole discretion.
5. Match Conduct
By submitting a score, you affirm it is accurate. The opposing player has 15 minutes to confirm or dispute. Disputes are handled through the in-app dispute system (up to 3 rounds of proposals before admin escalation). Attempting to abuse the dispute system to delay or falsify outcomes is a violation of these Terms.
6. Season Pass
Season 1 for each sport is free. From Season 2 onwards, a Season Pass is required to participate in the ranked league (10 € per sport; 5 € for additional sports). Season Passes are purchased directly in the app, through the distribution platform's in-app purchase (Apple's App Store or Google Play). Season Pass purchases are binding and non-refundable, except as required by applicable consumer protection law.
Price circumvention. Any attempt to obtain a Season Pass, a discount (for example the "additional sport" price), or access at a price lower than the one applicable to you, including by modifying the app, manipulating the store, or using a tampered device, constitutes fraud and a violation of these Terms. Where fraud is established, Smashd reserves the right to suspend or revoke the affected access or your account, with no compensation or refund from Smashd. Amounts paid through an in-app purchase are collected by the distribution platform (Apple or Google), not by Smashd; any refund request is a matter for that platform. Any measure taken under this clause is proportionate to the severity of the conduct and based on evidence.
7. Intellectual Property
The Service, including its design, code, graphics, and content, is owned by Smashd and protected by intellectual property law. You may not reproduce or distribute any part of the Service without our written consent.
You retain ownership of content you post (e.g., match results, profile information) but grant Smashd a worldwide, royalty-free licence to use, store, and display that content in connection with operating the Service.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind. We do not guarantee uptime, accuracy of rankings, or uninterrupted access. To the maximum extent permitted by law, Smashd's liability is limited to the amount you paid us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time from "Settings → Delete Account" in the app. Termination does not affect anonymised historical match data.
10. Changes to Terms
We may update these Terms. We will notify you of material changes via in-app notification. Continued use after the effective date constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of France. Any disputes shall be submitted to the competent courts of Paris, unless mandatory consumer law in your country of residence provides otherwise.
